In Less Than Three Weeks The Charges Against His Client Were Withdrawn As a Result of Irving Solnik's strategies and Herculean Efforts!

A rare feat but not for Irving Solnik!

“My client, George, is a young man who is studying for his Masters Degree at York University and works part time-a substantial amount of hours each week working with, repairing, building and selling computers.

He is quite knowledgeable and talented in Information Technology and computers and is studying for his masters degree.

He had a girl friend, Nicole-they had been dating for almost ten years-since they were young teenagers.

One night he drove over to Nicole’s parent’s home-she was living with her parents-who treated my client virtually as a son. After all and he had been with their daughter for about ten years.

About one hour after George arrived he and Nicole began to argue and the argument became heated with each of them shouting at the other.

The argument began when it became apparent to George that Nichole wanted to date or in fact dated others and George became jealous because he loved Nichole.

The vehemence of their arguments increased greatly until they had the mother of all arguments during which the verbal onslaughts increased in intensity.Then after a particularly heated exchange of words Nichole committed a heinous act.

She dialed 911 on her cell phone and called the police. She told them George had criminally assaulted her that evening and that George had stolen her cell phone. (He had taken it to see the telephone numbers she had dialed to determine if she was calling another man. He then left the cell phone in her home and had not stolen it as Nichole stated).

The alleged criminal assaults he had made were such that Nichole stated to the police that he had criminally assaulted her whereas in fact each of them hurled barbed angry words in anger against each other on the telephone.

However when she spoke to the police she omitted to state that the alleged assaults-words only-that were made on the telephone.

George then decided to leave the house and return to his home when Nicole’s mother called him and told him the police were at her home and that George should return.

George did so and as soon as he arrived at the house he was immediately arrested by the police, handcuffed and taken into the basement of the home for questioning. He was kept there for several hours before he was taken to the jail and incarcerated.

Prior to George’s removal by the police Nichole’s mother made several futile attempts to talk to them and tell them that George and Nichole had an argument-no phone was stolen and there were no criminal assaults made by George.

The police told her she should keep quiet and that she was a “bad” mother because George, according to the police, was “no good” and how could Nichole’s mother stand up for him because he “stole the cell phone and criminally assaulted her daughter.”

They told her to sit down and not to interfere. She then sat down beside her husband and both could not believe what was happening.

George had no criminal record-not even a driving ticket and the same not withstanding everything, George was put in the holding cell at the police station for several hours before he was released by the police after he signed a peace bond and agreed to refrain from contacting Nichole or her parents.

He was also to appear in criminal court several days later.

The police grossly over reacted to the telephone call by Nichole. Six heavily armed police 0fficers-SWAT TEAM members were sent to arrest George and they treated him as if he was a well known and dangerous criminal or terrorist, in their zealousness.

In fact George was born in Iran as a Moslem but had lived most, if not all of his life in Canada. Nichole’s parents were well aware of this and nevertheless treated George as well as they would have treated their own son-if they had a son-not a daughter.

The action of the police was akin to swatting a mosquito with a cannon. Heavily armed SWAT TEAM officers came for him as if he were also heavily armed and a threat to them as well as Nichole.

George appeared in criminal court at the specified date and time where he was given a written disclosure of the evidence the police had put together and another date and time was set when George was to appear again in criminal court to set a date for a trial.

By this time George realized that he was in serious trouble and faced criminal charges that might include a jail term and/or a fine. If such did happen he would have a criminal record for life that could readily jeopardize his future.

He then called me and explained all that transpired. I was stunned to hear that he was arrested by 6 SWAT TEAM police officers and treated in the degrading manner that he was treated-as if he was a highly dangerous and infamous criminal.-terrorist.

Was it because he was a Moslem (not practicing) and Iranian by birth? Or were there other undisclosed obscure reasons?

This was the very first time that I, as a lawyer, can remember or have ever heard of a six member SWAT TEAM being sent on a minor domestic issue.

What other surprises were in store? It became obvious that I must change my strategies and tactics that usually always succeeded in the past for similar domestic issues.

I pondered what must be done and finally decided on the unique strategy and blitzkrieg tactic I should use.

I would put the new strategies and tactics into effect at the next court hearing that was two days away. Then I briefed George on what he must do-nothing-until I advised him otherwise.

I entered the court room, signed in as counsel and asked one of the Crown attorney’s assistant if she would put my case at the head of numerous cases to be heard. She did not say a word but flashed me a rather dirty look that did not augur well.

The first case was heard and to my great surprise, my clients name then reverberated over the din in the Court room. I told the Crown attorney that I wanted a crown pretrial immediately.

Without another word I addressed the Crown but looked at the Judge and said “I want a pretrial with the Crown now.” The crown attorney looked at me in surprise but also noted that the Judge had indicated agreement.

She then asked when I wanted the pretrial and I answered-“now, or the very next one available.” I then asked the Crown Attorney (the prosecutor) if she had more disclosures for me and she indicated negatively.

She agreed to my request and I left the courtroom with George in tow where two crown attorneys were deep in negotiations with two other lawyers.

Without being asked I seated myself on the only vacant chair in the closet like office and awaited my turn-it came quickly, to my delight. I then presented my argument to the Crown, pointed out the holes in his case, stressed the use of the SWAT TEAM and their actions.

How would it look if it was made public that a six member SWAT TEAM was involved in a minor domestic argument between two young people barely out of their teens. The Crown attorney obviously knew what I was hinting at.

He, the crown attorney, was obviously embarrassed and I suggested that George pay $50.00 to a charity of the Crown’s choice but the Crown said no.

He wanted George to pay $1000.00 to a charity in return for withdrawing the two charges against George.

After several minutes of negotiations we agreed on $400.00 that was to be paid to a charity of the Crown’s choice. I thanked the Crown for his compassion and understanding and then went to where George was sitting and fidgeting nervously.

During the course of negotiations I gave the Crown several witness statements-from Nicole and from her parents. The statement from Nichole was difficult to obtain but at the very last minute she signed it.

The statements totally refuted the criminal charges and explained the ludicrous actions of the six police officers-the SWAT TEAM.

If the charges had not been withdrawn and a trial was held, the police would appear like idiots-six heavily armed police against a young man-a University student, with no criminal, not even a driving ticket on his record?

The reputation of the police would be ruined-especially the SWAT SQUAD. The Crown obviously was aware of this for I pointed it out in no uncertain terms and graciously withdrew the charges.

Obviously my strategies and tactics worked well! Firstly I demanded a pretrial with the Crown that was totally unexpected-my intended strategy that had spectacular results.
Secondly my tactic of having the witness statements prepared and signed, was my first tactic-again a tactic that yielded spectacular results.

My third tactic was to show the Crown and allow him to read the witness statements and my allowing the Crown attorney to read them was the coup d’etat.

It is virtually a rule that nothing the defense lawyer has is ever divulged to the crown and is to be used only at the trial and never before. I rarely break true and tried rules and I did bend and break them in this matter for a number of vital reasons.

The most important reason was that the Crown needed the evidence from Nicole when she would be examined by the Crown and the evidence she would give would surely make a laughing stock of the Crown and the Attorney General-they would find it most difficult to cover it up in the future.

The last tactic I made was to suggest to the Crown how foolish it would appear to the public and others, what the SWAT TEAM had done.

All is well that goes well and in George’s case not only did my actions-strategies and tactics-go well-they were spectacular successes.

George is a free man now without a criminal record and he is free to pursue his studies for his master’s degree. Nicole initial statements to the police made in the heat of anger simply backed fired and caused her much embarrassment.

The Hospital for Sick Children is $400.00 richer thanks to George’s charitable donation and thanks to the Crown attorney for his compassion and understanding. All is well that ends well or so I thought.

When I address this case again in the very near future the ultimate truth of what Nichole’s words and actions would be revealed.

Finally had my strategies and tactics not succeeded when I used them, George could possibly have been convicted and would always have a criminal record for the rest of his life that could have had an adverse effect on his future.

However your right to remain silent does not mean you can lie to the police. Simply refuse to answer all questions.

Should I Just Plead Guilty?
No. Never-Ever--Don’t consider pleading guilty unless you are guilty according to the law.

You may think you are guilty but you may not be legally guilty unless there was “mens rea"-guilty intent.

The prosecutor or crown attorney must prove beyond a reasonable doubt that you committed the offence you are charged with.

There are numerous defences that an experienced lawyer can use to show there is reasonable doubt to an impartial Judge or Judge and jury.

Never plead guilty!
Unless you have spoken to an experienced criminal lawyer and revealed to him/her everything truthfully-a moral and categorical imperative-never plead guilty.

Police Tactics:

The number of criminal charges that exist in the Canadian Criminal Code are almost without count and they include but are not limited to:

Whether it is delivered by the lone officer in Saskatchewan, or by the Royal Canadian Mounted Police on Parliament Hill, the enforcement of Canada's criminal laws affects all of us.

Over $11 billion was spent on policing, courts, legal aid, criminal prosecutions, and adult and youth corrections in 2000/01.

The crime rate in Canada is measured by the number of Criminal Code incidents reported to police. In 2001, Canada posted its lowest crime rate in 25 years with 7,655 incidents per 100,000 people.

The drop in police-reported crime is not the only indicator that the crime rate has actually fallen, however.

According to a 1996 survey, victim-reported crime (which includes incidents not reported to police) decreased from 1993 to 1996.

Interestingly, better behaviour seems to be catching on abroad as well as at home: Canada's police-reported crime rate has been mirrored in several other countries.

CARELESS DRIVING:
Section 130 of the Ontario Highway Traffic Act establishes the offence for careless driving as follows:

S.130. Every person is guilty of the offence of driving carelessly who drives a vehicle or street car on a highway without due care and attention or without reasonable consideration for other persons using the highway and on conviction is liable to a fine of not less than $200 and not more than $1,000 or to imprisonment for a term of not more than six months, or to both, and in addition his or her licence or permit may be suspended for a period of not more than two years.

The offence of careless driving is of a quasi-criminal nature. It goes beyond mere error in judgment. It indicates a measure of indifference, a want of care for the matter in hand and an indifferent regard for the rights of other.

To support a charge of careless driving, the evidence must prove beyond a reasonable doubt that the accused drove without due care and attention or without reasonable consideration for others.

The standard of care and skill to be applied has been long established and is not that of perfection.

The test is whether the accused, in light of existing circumstances of which he was aware or of which a driver exercising ordinary care should have been aware, failed to use the care and attention or to give to other persons using the highway the consideration that a driver of ordinary care would have used or given in the circumstances.

The use of the term “due care”, which means care owing in the circumstances, makes it quite clear that, while the legal standard of care remains the same in the sense that it is what the average careful man would have done in like circumstances, the factual standard is a constantly shifting one, depending on road, visibility, weather conditions, traffic conditions that exist or may reasonably be expected, and any other conditions that ordinary prudent drivers would take into consideration.

It is a question of fact, depending on the circumstances in each case.

There is a further important element that must also be considered, namely, that the conduct must be of such a nature that it can be considered a breach of duty to the public and deserving of punishment.

Alcohol laws can be found under the Criminal Code of Canada.
Most people relate alcohol laws with drinking and driving. This can be found, for example, in section 253(1) of the Criminal Code, which establishes the offence of operating a motor vehicle while being impaired by alcohol.

The following is the provision:Operation of a motor vehicle while impaired:
253. (1) Every one commits an offence who operates a motor vehicle or vessel or operates or assists in the operation of an aircraft or of railway equipment or has the care or control of a motor vehicle, vessel, aircraft or railway equipment, whether it is in motion or not.

(a) while the person’s ability to operate the vehicle, vessel, aircraft or railway equipment is impaired by alcohol or a drug; or
(b) having consumed alcohol in such a quantity that the concentration in the person’s blood exceeds eighty milligrams of alcohol in one hundred milliliters of blood.

For greater certainty: (2) For greater certainty, the reference to impairment by alcohol or a drug in paragraph (1)(a) includes impairment by a combination of alcohol and a drug.

Section 254 of the Criminal Code gives police officers the authority, under certain circumstances, to test individuals (e.g. through breathalyzers and sobriety tests).

Worth noting is that, in Ontario, where a police officers conducts a breathalyzer test and an individual’s results are over the legal limit, the police officer has the power to request that the person surrender their driver’s license under s. 48(3) of the Ontario Highway Traffic Act.

Section 255 of the Criminal Code establishes different punishments for accuseds convicted under s. 253 (noted above). For example, an individual who was impaired while operating a motor vehicle (i.e. under s. 253(1)(a)) and caused another person to die could face life imprisonment.

Furthermore, an individual who was impaired while operating a motor vehicle (i.e. under s. 253(1)(a) and caused bodily harm to another person could be found guilty of an indictable offence and liable to imprisonment for a term of up to 10 years.
